					<description>If the state where this dispute is taking place has an equal rights amendment, then it jumps to strict scrutiny, meaning the discrimination must be &quot;&lt;strong&gt;neccessary&lt;/strong&gt; for a &lt;strong&gt;compelling&lt;/strong&gt; state interest.&quot;  However, Josh is not a state actor, so he has no duty to uphold these rights.  Therefore, CM can maintain the advantage of being a girl.</description>
